Brand new! I saw them was so excited I bought right away because I thought they were men's sz.9. My loss, your gain. Merrell are the most comfortable, durable, long lasting shoes ever, and they have vibram and gortex around the toe so they don't get wet in snow and rain. So mad they don't fit, if they did I would have kept them even though women's.
